Relocation in Florida

Have you been involved in a family law matter (such as divorce, paternity, or establishment of a parenting plan), and you are looking to move with your child?  Are you seeking to block a former spouse from moving with your child?  In Florida, there is a statute governing relocation that may apply even if you are moving to a different city within the state.  The Law Firm of Adam B. Cordover, P.A., will assess whether the relocation statute applies to your situation; if it does, we will formulate the right strategy and solution for you.

Relocation Agreement

If your move falls within the purview of the relocation statute, you may be able to come to an agreement with the other parent.  You should note that Florida law requires that a relocation agreement contains certain provisions, including a time-sharing (visitation) schedule for the non-moving parent.  When you hire The Law Firm of Adam B. Cordover, P.A., you can rest assured that you have an advocate negotiating for a relocation agreement that fits your circumstances.

Relocation Hearing

If you are unable to come to a relocation agreement, your dispute will be settled by a judge.  Fortunately for both parents, a petition to relocate is accorded priority in the court’s schedule.  In rendering its decision, the court will look at the many factors outlined in the relocation statute, including the following:  (i) the quality and duration of the child's relationship with each parent; (ii) the quality and duration of the child's relationship with other people, such as siblings, grandparents, and other significant persons in the child's life; (iii) the reason each parent has for supporting or opposing the move; (iv) the child's preference, taking into consideration the age and maturity of the child; (v) the current employment and economic circumstances of each parent; and (vi) the feasibility of preserving the relationship between the child and the non-moving parent.

The Law Firm of Adam B. Cordover, P.A., will stand with you and defend your rights in your relocation matter.
